Off-duty conduct and dismissal
Article by Fabian Flintoff, Lawyer
Off duty conduct of employees has come under greater scrutiny since the advent of social media and the rise of movements seeking rapid changes in society.
Historically the issue comes up far more often in the United States. However, even in Australia, we have seen an increase in dismissals for off-duty conduct including:
- political statements
- inappropriate comments on platforms such as Facebook and Twitter
- insulting comments about work colleagues
- length of employment
- disciplinary record
- the nature of the position
- the degree of trust required in the role
- the response when confronted with allegations of misconduct including whether such a response was honest or dishonest
- any mitigating factors
- anything else that relates to the viability of continuing the employment relationship.
